Zooey Deschanel Files for Divorce From Ben Gibbard

She and Him is still happening, but the days of His and Hers are over.

Zooey Deschanel has filed for divorce from Death Cab for Cutie frontmant Ben Gibbard after a little more than 730 days of marriage—and two months of separation, E! News has confirmed.

The New Girl star cited irreconcilable differences as the reason for the split and asked that the court terminate Gibbard's right to spousal support, according to the petition filed Dec. 27 in L.A. Superior court.

Deschanel stated in the paperwork that she earns $95,000 a month from her various gigs as an actor, singer and songwriter.

Meanwhile, fans of the seemingly cute-as-a-button couple were probably pretty blindsided in November by news of them parting ways.

In what seemed to be an indie match made in heaven, Deschanel and Gibbard tied the knot in September 2009, the first trip down the aisle for both.

It seemed to be the case after photogs caught shots of Halle Berry accessorized with a certain piece of jewelry on a very specific finger.

We know the saying, "third time's a charm," and clearly there are plenty of Hollywood couples who have proven this to be true when it comes to marriage, but in Halle's case...we can't be too sure.

Both of the lovebirds' reps were contacted by E! News and had either no comment or no information to give us.

So, are they playing it coy or is that just a random piece of jewelry that she decided to place on her ring finger (knowing we'd totally get excited)? Either way, the duo have surpassed Millionaire Matchmaker Patti Stanger's expectations, so that's good!

Not-So-Happy New Year: Ellen Barkin Allegedly Shoved by Police Officer in NYC

New Year's Eve was not exactly another happy day for Ellen Barkin.

The 57-year-old actress headed to Twitter to vent about a run-in with a police officer who allegedly shoved her while she was walking near her apartment with her director boyfriend, Sam Levinson, in New York City Saturday night.

"Just threatened on my street by NYPD, cop shoved me, both hands, onto sidewalk..Is it a crime 2 stand in the street in NY? WTF is going on here?" the Another Happy Day star tweeted.

Barkin, who had been tweeting about policemen in the area making random arrests that night, said she was trying to help a girl who had been arrested when the incident occurred.

"I was trying 2 make my way 2 young girl they had thrown in2 the van.She was not a protester. Was not drunk. She was walking home," Barkin went on.

Levinson, captured the incident on camera and posted the clip on his Twitvid account, writing "Corner of 13 & 5th, where the #NYPD was arresting innocent ppl." Prior to that, the 26-year-old filmmaker wrote, "Walking with @EllenBarkin. #NYPD had blocked off streets. Thanks for welcoming in the New Year!"

Sunday morning, Barkin continued to discuss the incident, writing, "I have never been afraid of a NY policeman until last nite. What I saw was random & senseless arrests and unnecessarily threatening behavior."

The NYPD has yet to comment on the incident, but if and when they do we will bring you their response.

Justin Bieber and Selena Gomez's Late Night New Year's Eve Party Read

Just because Justin Bieber and Selena Gomez performed on different New Year's Eve television specials last night, doesn't mean they didn't get to celebrate together.

In fact, they partied into the wee hours...

Gomez was by the Biebster's side at his private party at the Glass House following his performance on Dick Clark's New Year's Rockin' Eve.

"He...danced with Selena, showing off, picking her up and swinging her around like it was Dancing With the Stars," a source tells me.

The "Baby" pop star also took over the deejay booth to play "Happy New Year," his new tune with Jaden Smith. Hosted by Activision, Bieber and his guests also played Skylanders Spyro's Adventure.

The bash lasted until three in the morning.
